Media Development Authority of Singapore (MDA) has announced the first triennial review of the country's Code of Practice for Market Conduct in the Provision of Mass Media Services this month (March). MDA is seeking public consultation on proposed changes to the Code which was first implemented in April 2003 to address competition issues related to the broadcasting and print sectors. MDA has summarised six proposed revisions to the Code.
• Extend scope of Code beyond broadcasting and print sectors to cover entire media industry
• Enable any media service provider to broadcast events of national significance, not just free-to-air television and radio licensees
• Prohibit anti-competitive leveraging to ensure providers with influential affiliates are unable to prevent effective competition
• Amend market and dominance definitions to ensure predefined markets and dominant licensees comply with their special obligations
• Change access to advertising capacity to ensure dominant licensees provide reasonable and non-discriminatory prices, terms and conditions
• Alter enforcement procedures so that persons involved in a complaint may comment on MDA's preliminary decision within 30 working days
MDA aims to issue the revised Code in the fourth quarter of 2007.
Our take...
MDA intends to update the Code to help nurture a pro-business environment whilst ensuring more media choices for the public. Proposed revisions to the Code will better address changes in the media industry such as the introduction of high-definition television (HDTV) and Internet protocol television (IPTV). Revision will also help to ensure the Code remains relevant and effective in promoting fair market conduct and competition within Singapore's media industry.
