European Court of Justice ruling on extra-territorial content access restrictions

A recent ruling from the European Court of Justice has thrown the sale of territorial rights on which the pay TV industry is based in to question. While the initial ruling centres on soccer rights, the decision has implications for all content types and the licensing of content to operators across the content distribution chain. Our briefing summarises some of the issues and suggests remedies that may have to be adopted if cross-territory sale of pay TV decoders and smart cards becomes common-place
